Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Trix Affiliates platform, website at trixaffiliate-os.com, desktop application, and related services (together, the “Service”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a company, you represent that you have authority to bind that company.

The Service is software for planning and operating affiliate marketing businesses. It scores market opportunities, generates draft content, helps organise affiliate programs, products and campaigns, and records performance data you supply or connect.

The Service is a tool. It does not operate your business for you, does not guarantee results, and does not act as your agent with any affiliate network, advertiser or platform.

Paid plans are offered on a monthly subscription. New subscriptions begin with a 14-day free trial.

Prices are stated in US dollars and exclude any applicable taxes. We may change prices with at least 30 days’ notice; changes apply to your next billing period, never retroactively.

Payments are processed by Stripe. We do not receive or store your full card number. Your use of payment processing is additionally subject to Stripe’s terms.

You may cancel at any time from your account settings or the billing portal. Cancellation stops future charges; your plan remains active until the end of the billing period already paid for.

Except where required by law, payments are non-refundable, and we do not provide refunds or credits for partial billing periods or unused features. If you were charged in error, contact support@trixaffiliate-os.com and we will review it in good faith.

Each plan includes limits, such as the number of brand workspaces. If you downgrade and exceed the new limit, excess items are not deleted but become read-only until you are within the limit or upgrade again.

You are responsible for the security of your credentials and for all activity under your account. Notify us promptly at support@trixaffiliate-os.com if you suspect unauthorised access.

You retain ownership of the data, text and materials you submit (“Your Content”). You grant us a limited licence to host, process and display Your Content solely to operate and improve the Service for you.

You are responsible for ensuring you have the rights to Your Content and that it does not infringe anyone else’s rights or break any law.

The Service can generate drafts using artificial intelligence. AI output may be inaccurate, outdated, biased, or resemble output produced for other users. You are solely responsible for reviewing, editing, fact-checking and approving anything before you publish it. Nothing publishes without your action.

You are responsible for complying with the rules of any platform you publish to, and with applicable advertising and disclosure law, including affiliate-relationship disclosure under the US FTC Endorsement Guides or your local equivalent.

You agree not to use the Service to:

• break any law, regulation or third-party platform policy;
• publish deceptive, fraudulent or knowingly false claims;
• generate spam, bulk unsolicited messaging, or artificially inflate traffic or clicks;
• infringe intellectual property or misappropriate another brand’s identity;
• reverse engineer, resell or white-label the Service without written permission;
• attempt to gain unauthorised access to the Service, other accounts, or our infrastructure;
• upload malware or interfere with the Service’s normal operation.

We may suspend or terminate accounts that violate this section.

Nothing in the Service is financial, investment, legal or tax advice. We are not your advisor. You keep 100% of any affiliate commissions you earn; we take no percentage of your earnings.

The Service can connect to third-party platforms and networks. Those services are controlled by others, governed by their own terms, and may change or withdraw access at any time. We are not responsible for third-party services or for any loss arising from them.

We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. We may modify, suspend or discontinue features, and will give reasonable notice of material changes where practical.

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, to the fullest extent permitted by law.

To the maximum extent permitted by law, Trix Affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, lost revenue, lost business opportunity, or loss of data, arising out of or related to the Service.

Our total aggregate liability for all claims relating to the Service is limited to the amount you actually paid us in the twelve (12) months immediately before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold harmless Trix Affiliates from claims, damages and reasonable costs arising from Your Content, your use of the Service, or your breach of these Terms or of applicable law.

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms, non-payment, or where required by law. On termination, your right to use the Service ends; sections that by nature should survive will survive.

We may update these Terms. If changes are material we will give reasonable advance notice by email or in-app. Continuing to use the Service after changes take effect means you accept them.

These Terms are governed by the laws of the State of Louisiana, United States, without regard to conflict-of-law rules. The courts located in that jurisdiction have exclusive jurisdiction over disputes, except that either party may seek injunctive relief where appropriate.
